Sex Abuse Cases
Teenage babysitter sexually abused minor children. Babysitter had one prior instance of sexually abusing a minor. Insurance company for the Babysitters' parent's insurance company paid their $100K policy limits.
Minor boy of a divorced family, primary custody with the mother, visited father and his new wife on weekends. The husband's new wife had children by former marriage, and eldest son of the new wife (who was four years older than the abused minor) sexually abused stepfathers' son every other weekend over the course of more than one year. Substantial settlement for a confidential amount approved by the Court on a structured basis. Recovery was against the father's homeowner's insurance company.
Auto Cases
Retired Attorney ran stop light running into van containing 89 year old woman. The 89 year old woman went from hospital to a nursing home, and died about a month later. Settlement of $750,000 from the attorney's insurance company.
Sheriff's deputy ran stop sign into the rear of pickup truck driven by owner of small construction business. Neck surgery. Total settlement of $225,000 paid $100,000 statutory limit by the Sheriffs office, $100,000 by one uninsured motorist insurance company and $25000 by a second Uninsured motorist insurance company.
Raccoon jumped from top of trash truck, landing on oncoming pickup truck. The raccoon actually came tin the windshield of the pickup truck knocking out the driver and scratching up driver's chest before dying. Pickup truck passenger was able to safely steer truck to the side of the road. Only treatment was hospital bills of approximately $5000. This case was turned down by more than one attorney and. defended by the trash company attorneys on the theory that they were not responsible for the actions of a wild animal. After depositions, raccoon may have gotten on truck either when the driver bumped into trees on property of one of his pickup locations or the raccoon was in a dumpster picked up by the driver and the driver failed to secure the top of the truck.. Man in back of pick up truck on way to work hit by car running stop light. He was ejected from the back of the pickup truck, and suffered, back and leg injuries. Settled $200000 policy limits.
Hit & Run
Rental Agent was hit on the arm by driver in hurry to get to airport for a flight. Driver was followed to the airport and police were called. It was suspected that the driver of the rental car and a passenger that was not drinking switched places. No charges were filed. Injury: surgery to left wrist, with loss of job. Settlement: $100,000 with the insurance company for the man who told police he was driving. $30,000 settlement with the insurance company for the man who had rented the car.
Truck Cases
T-bone at intersection when 18 wheeler ran stop light. Injury to temporarily unemployed, divorced woman. Injuries to neck and back, resulting in eventual neck surgery. Settlement of $225000 paid by the trucking company who fought the claim initially because of pre-existing neck problems.
Slip and Fall Cases
Pregnant Woman walking in parking lot at night of a trailer park Bad lighting led to woman tripping over a log in. the roadway, causing damages to the as yet unborn, baby. Baby born with birth defects. Settlement for the trailer park's policy limits of $1 million.
Fall in Wal-Mart near the flower department. Leaky cooler caused woman to fall, aggravating low back injury. Cooler had leaked before, and repaired recently. Wal-Mart defended blaming the repair workers. Settlement $50,000 due to herniated disc.
Fall in Wal-Mart resulting in knee surgery. Water was from water coming from leaky flower cooler near the front of the store that had recently been repaired by an outside agency. Customer who fell was following Wal-Mart employee in cosmetic department on the other side of the main aisle. Failure to warn led to liability on behalf of Wal-Mart. Confidential settlement.
Dog Bite Cases
Police officer bitten on trigger finger by dog while responding to a call. $25,000 settlement.
Female bitten in the face by a dog in a bar. Owner defended trying to claim that son owned dog, and he just let it stay there once in a while. Vet testified that it was bar owner's dog. Animal control testified that bar owner identified dog as his. Injury: Dog bit thru the lip- Scaring, loss of feeling in lip. Jury Verdict for $77,000.
Girl attacked by two dogs at neighbor's house where she was a guest. Over 100 stitches required. Homeowner's policy paid their $100,000 policy limits.
Boating Accidents
Passenger in boat thrown forward hitting lower back on interior of the boat when boat ran aground. Negligence against boat owner/driver for going too fast in shallow water. Settlement $20,000 for low back problems.
While docking boat, woman tripped over old metal pipe that had been sunk into the ground near boat ramp. The purpose of the pipe was to tie boats. However, the pipe was not visible in the murky water at high tide, and should have been removed because it was too close to the boat ramp.
