What Is a Wrongful Death Action?
A wrongful death action is brought by the personal representative (or executor) of the deceased for the benefit of a surviving relatives. Part of a successful wrongful death action requires proving that the relatives were dependent on the deceased for financial support or other help with daily living.
In a wrongful death action, a settlement may be recovered for:
- The value of the lost financial support for the remainder of the natural life span of the deceased
- Lost companionship and pain and suffering, in the case of a surviving spouse
- Lost parental companionship and instruction and pain and suffering, in the case of surviving minor children
- Medical and funeral expenses
- Lost future earnings that would have otherwise been distributed through the deceased's estate following death after a normal life span
