What Is a Wrongful Death Action?

A wrongful death action is brought by the personal representative (or executor) of the deceased, for the benefit of a surviving spouse, children, parents, adopted siblings or other blood relatives. Part of a successful wrongful death action requires proving that the relatives — in the case of surviving parents, siblings or other blood relatives besides the spouse or children — were dependent on the deceased for financial support or other help with daily living.

In a wrongful death action, compensation may be recovered for:

  • The value of the lost financial support for the remainder of the natural life span of the deceased
  • Lost companionship and pain and suffering, in the case of a surviving spouse
  • Lost parental companionship and instruction, and pain and suffering, in the case of surviving minor children
  • Medical and funeral expenses
