| Because dog bites are so common, there is a Florida Statute that
deals directly with this issue. A dog does not get a "free
bite" as it does in some states that require prior owner knowledge
of his dog biting. Instead, Florida allows recovery from any injury
by a dog - whether it has been known to bite before or not. Because
of infections and the seriousness of many bites, it is a good idea
to go to a medical provider for help. If you are bitten by a dog
owned by someone that owns real property, that property owners'
homeowners insurance company will usually cover the damages whether
the dog is on the property owned by the dog owner or not when it
injures its victim.
There are just a few defenses available to dog owners. The dog
owner can post a "bad dog" sign to indicate his dogs
vicious propensities, and logically, you also cannot intentionally
aggravate or antagonize a dog and then blame the dog owner for
the resulting injuries.
